The Office of the Kansas Attorney General’s Special Litigation & Constitutional Issues Division is seeking a dynamic, experienced litigator who wants to help lead the Office’s efforts to protect constitutional rights and reign in federal excesses.

The Division’s primary focus is on suing the federal government (for example, in Kansas v. Biden, which challenges the federal government’s unlawful student loan forgiveness program) and submitting comments on proposed federal regulations that may infringe on state sovereignty or constitutional rights. But the division also handles other affirmative and defensive cases that involve constitutional issues, including litigation challenging the constitutionality of state statutes.

We need an experienced litigator who can be the second in command of this effort. The successful candidate will help lead a team of two to four attorneys pursuing the most interesting and consequential cases the Office is handling. This is an opportunity to litigate cases that are national in scope and filed in federal courts across the country, as well as to mentor the mission-minded but less-experienced attorneys in the Division.

Strategic vision, political savvy, and compatibility with the administration’s legal philosophy and goals are all important. We expect to file suits with a strong chance of landing in the U.S. Supreme Court, and need an Associate Deputy Attorney General who can litigate and help choose cases with that end in mind.

Qualifications

 

Licensing & Certification

  • Membership in good standing with the Bar of the Supreme Court of Kansas or eligible for admission on waiver
  • A valid driver’s license

Minimum Qualifications

  • At least four (4) years post-J.D. experience
  • Significant experience in criminal, civil, or administrative litigation
  • Excellent writing ability
  • Prior experience or demonstrated interest in federalism, separation of powers, and constitutional rights

Preferred Qualifications

  • At least six (6) years post-J.D. experience
  • Judicial clerkship
  • Experience supervising and mentoring attorneys or related staff
  • Experience with strategic public-interest litigation or related efforts
  • Experience litigating under Section 1983, the Administrative Procedure Act, or similar statutes
