Case Description
State petitioned for Summary Judgment, alleging that Defendant members of the Maricopa County Medical Society (Maricopa) made agreements with competing member physicians to set maximum fees that physicians could claim in full payment of health services provided to policyholders. The Supreme Court held that a horizontal price-fixing scheme had been proven by the Plaintiff State and was therefore, a per se violation of §1 of the Sherman Act. Partial summary judgment granted
